Agreement

These Terms of Service govern access to and use of PropFlow, a CRM-style SMS outreach platform for real estate professionals and teams. By using PropFlow, creating an account, visiting our website, or sending or receiving messages through the platform, you agree to these Terms and our Privacy Policy.

Use of the Platform

PropFlow may be used to manage contacts, conversations, templates, campaigns, tasks, pipeline activity, phone numbers, and related business records. You are responsible for the accuracy of the data you upload or enter and for ensuring that your use of the platform complies with applicable laws, carrier rules, and industry requirements.

Accounts and Organizations

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account or organization. You must keep account, company, billing, and contact information accurate and up to date.

SMS Messaging Terms

PropFlow enables SMS messages for real estate-related communications, including property inquiry follow-up, appointment scheduling, requested information, follow-up questions, and customer support. More information is available on our SMS Program page.

• Message frequency varies based on the recipient relationship and use case.
• Message and data rates may apply.
• Recipients may reply STOP or UNSUBSCRIBE to opt out at any time.
• Recipients may reply HELP for help or contact support@propflowsms.com.
• Consent to receive SMS messages is not a condition of purchase.
• Opt-in, opt-out, and message activity may be logged for compliance and audit purposes.

Consent and Compliance Responsibilities

Users are responsible for obtaining and maintaining all required permissions and consents before sending messages. This includes compliance with the Telephone Consumer Protection Act, CTIA guidelines, carrier requirements, The Campaign Registry requirements, 10DLC rules, CAN-SPAM where applicable, state laws, and all other laws or regulations that apply to your messaging activity.

You may not use PropFlow to send unlawful, misleading, abusive, harassing, deceptive, high-risk financial, lending, debt relief, foreclosure rescue, prohibited, or non-compliant messages. You may not message people who have opted out, requested not to be contacted, or otherwise withdrawn consent.

Prohibited Uses

You may not use PropFlow to:

• Send spam, unsolicited bulk messages, or messages without proper consent.
• Violate telecom, carrier, privacy, consumer protection, or anti-spam rules.
• Impersonate another person or business.
• Upload malicious code or interfere with platform security or availability.
• Collect, sell, or misuse personal information without authorization.
• Send content that is fraudulent, threatening, hateful, or illegal.

Service Providers and Carriers

SMS delivery depends on third-party providers, carriers, aggregators, and recipient networks. Delivery is not guaranteed. Messages may be delayed, filtered, blocked, rejected, or limited because of carrier rules, registration status, recipient device availability, content review, rate limits, compliance issues, or network conditions.

Fees and Billing

Paid features, subscriptions, usage charges, carrier fees, registration fees, phone number costs, or messaging charges may apply. You are responsible for all charges associated with your account, including messaging traffic initiated by your users or organization.

Data and Privacy

Our Privacy Policy explains how we collect, use, share, and protect information. By using PropFlow, you authorize us to process account, contact, messaging, consent, audit, and usage data as needed to provide and secure the platform.

Suspension and Termination

We may suspend or terminate access to PropFlow if we believe an account is violating these Terms, creating security risk, causing carrier or compliance issues, sending prohibited messages, failing to pay required fees, or otherwise harming the platform, recipients, or third parties.

Disclaimers

PropFlow is provided on an as-is and as-available basis. We do not guarantee uninterrupted service, error-free operation, message delivery, compliance approval, campaign approval, or specific business results. You are responsible for reviewing your own legal and compliance obligations.

Limitation of Liability

To the fullest extent permitted by law, PropFlow will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, carrier filtering, rejected campaigns, or undelivered messages.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of PropFlow after updates means you accept the updated Terms.
